TBRA Program Appeals

The section that follows is only for Tenant-Based Rental Assistance (TBRA) Program applicants who have the right to appeal.

Review of application

If an applicant fails to submit a completed application package within the required fourteen (14) days, the Program Manager will send a letter notifying the applicant that they did not comply with the requirements of the program and are no longer eligible. The applicant will be given fifteen (15) days from the date of the letter to file an appeal.  This will provide an applicant the opportunity to submit additional information and/or clarify any defects in the initial application.  All appeals received on time will be reviewed by the Administrator of the Housing Assistance Programs and a determination letter will be mailed out within ten (10) days.

Applicant deemed ineligible:

An applicant who submitted a complete application but did not meet the criteria for the program will be deemed ineligible. The Program Manager will send a letter to the applicant notifying them that they are ineligible. The applicant will be given fifteen (15) days from the date of the letter to file an appeal. All appeals received on time will be reviewed by the Administrator of the Housing Assistance Programs and a determination letter will be mailed out within ten (10) days.

Termination of Tenancy

The program may terminate assistance for a participant if the household fails to adhere to the “Obligations of the Household” contained in the Sandy Tenant-Based Rental Assistance Voucher.  Prior to termination, the participant will be notified in writing that they did not comply with the requirements of the program and will be terminated in thirty (30) days. The applicant will be given twenty (20) days from the date of the letter to file an appeal.  All appeals received on time will be reviewed by a Hearing Officer who will conduct an informal hearing via a conference call. A final determination letter will be mailed out within fifteen (15) days.
